The buying first home legal process involves multiple stages, each with its own deadlines and requirements. Here's exactly what we do at each stage.
Before You Sign
Contract review is where most first home buyers feel overwhelmed. The contract of sale and Section 32 (Vendor Statement) contain critical information about the property. The Section 32 is the most vital legal document in Victorian conveyancing. It discloses encumbrances, zoning restrictions, and financial outgoings attached to the property.
We review these documents and explain them in plain language. We flag anything unusual, including sunset clauses that could allow a developer to cancel your off-the-plan purchase. Since 2019 amendments, developers cannot rescind contracts using sunset clauses without your consent or a Supreme Court order. We make sure you understand your rights.
After Contract Exchange
Once contracts are exchanged, we conduct title and planning searches to verify the property's legal status. We check for caveats, covenants, and any restrictions that might affect how you can use the property. If you purchased at a private sale, Victoria's 3-business-day cooling-off period applies. This does not apply to auction purchases or sales within 3 clear business days before or after an auction.
During this period, we coordinate with your lender. Settlement coordination is one of the most stressful parts of buying a home. Banks have their own timelines and requirements. We liaise directly with your lender's legal team to ensure everything aligns. If issues arise, we address them immediately rather than waiting for you to discover problems.
Settlement Day
PEXA settlement is the final step. This electronic platform handles the transfer of funds between all parties and lodges your new title with the land registry simultaneously. It's faster and more secure than the old paper-based system.
On settlement day, we verify all figures are correct, confirm funds have been transferred, and ensure your title is registered in your name. Once complete, you collect your keys from the agent. We confirm settlement with you immediately, so you know the moment your home is officially yours.
Our Communication Promise
Poor communication is the number one complaint about conveyancers. Stories of unreturned calls and unexplained delays are common. We operate differently. You'll have direct contact with your solicitor. No call centres. No offshore processing. We update you before you need to ask. If something changes, you'll know about it straight away.
Average conveyancing disbursements range from $300 to $600, covering title searches, registration fees, and other third-party costs. We provide a clear breakdown upfront, so you know exactly what you're paying for. No hidden fees. No surprise markups.
